Legal

Terms

Effective 30 August 2026

TrailA.io is owned and operated by Tech & Artery (Pty) Ltd (“we”, “us”, “our”). These Terms govern your use of TrailA.io, whichever role you use it in: Buyer, Creator or Landowner. Using the platform means you accept them as they stand at the version above.

1. Accounts and roles

You choose a role, Buyer, Creator or Landowner, once at onboarding. A Landowner or Buyer account belongs to a company, not an individual: teammates who join the same company share one account. A fourth role, staff, is TrailA.io's own team and isn't available through sign-up. You're responsible for what happens under your account and for keeping your credentials to yourself.

2. What TrailA.io is

TrailA.io is a marketplace for licensing wildlife photography and video. A Creator captures an asset on land a Landowner has authorised them to work on; a Buyer licenses that asset directly from the catalogue. Every asset carries a record connecting the Creator, the land authorisation, the capture, and the rights cleared before it's offered for licence, so a Buyer knows what they're licensing and on what authority.

3. Creators

You keep copyright in everything you capture. Uploading an asset, you confirm you actually captured it, that you're authorised under the relevant land-access agreement to capture on that land, and that it doesn't infringe anyone else's rights. You grant TrailA.io and the Buyers who licence your work only the rights each issued licence actually states, and you're paid your share of that licence's price, fixed the moment it's issued. An asset can be withdrawn, by you or by TrailA.io, if a rights issue is found; that never changes what you're owed on a licence already issued before it was. If you die, your rights pass to your estate under the ordinary law of succession, the same as any other property you own; nothing here transfers your copyright to TrailA.io or to a Landowner, and no licence already issued or share already accrued is affected. Your own land-access agreement may set out further terms for what happens to your catalogue after your death; where it does, that agreement controls.

4. Landowners

Your subscription gives you the tools to administer your land: approving Creators, setting the terms of each land-access agreement, and seeing what's been licensed from it. It's a framework for administering rights, not a licence in itself. Team and Business are self-serve, priced as shown at signup. Enterprise pricing and term are individually negotiated and set out in your own signed agreement, which controls over these Terms for anything it addresses directly. The standing terms every tier accepts regardless are at the Landowner Subscription & Land Access Framework Agreement. Some Enterprise Landowners' own signed agreements grant them further authority over assets captured on their own land specifically, for example reviewing a submission before it's offered for licence, setting its price, or negotiating a Buyer's licence directly rather than through self-serve checkout, beyond what the standing framework describes; where that's so, it's stated in that Landowner's own agreement, not here, and a Creator submitting under that Landowner's land-access agreement is told before they submit. A Creator's own revenue share on a licence still applies exactly as clause 3 above describes, regardless of who negotiated it.

5. Buyers and licences

Licensing an asset is a real transaction, not a request, except where an asset requires approval first: some assets need staff to approve your stated intended use before checkout is even possible. Each licence states the use type, territory and duration you chose at checkout, and covers only that. It can be revoked if a rights issue is found after issuance; we'll tell you why.

6. Payments

Payments and payouts run through a third-party payment processor, not through TrailA.io directly. We never collect or store your card or bank account details ourselves. Checkout and payout setup redirect to that processor's own bank-authorisation pages; a subscription is billed on a recurring authorised mandate until you cancel it.

7. Acceptable use

Don't try to get around the platform's access controls, including an asset's download gate or preview watermark. Don't scrape, bulk-download, or rehost anything you don't hold a licence for. Don't misrepresent who you are, what rights you hold, or what a licence permits. Don't upload anything you don't have the right to submit.

8. Enforcement

We can review any asset's rights, ask a Creator or Landowner to fix an issue before an asset goes live, suspend an account for a serious or repeated breach of these Terms, and revoke a licence issued in error or in breach of them. An asset's original file is reachable only through one gated route, and every attempt to reach it, successful or not, is logged.

9. Disclaimers

TrailA.io is provided as it stands, without a guarantee of uninterrupted availability. An on-page preview watermark is a visible deterrent, not a technical protection, and doesn't mean the underlying file is a separate, lower-resolution copy. We don't warrant that every asset is free of any conceivable third-party claim, only that the record behind it is real and checked as described.

10. Liability

To the extent the law allows, TrailA.io isn't liable for indirect or consequential loss arising from your use of the platform. Nothing here limits liability the law doesn't allow us to limit.

11. Termination

You can close your account at any time. We can suspend or close one for a serious breach of these Terms. Closing an account doesn't undo a licence already issued, or change what's owed on it.

12. Changes

We may update these Terms. We'll update the effective date above, and tell you directly if a change is material.

13. Governing law

These Terms are governed by the law of the Republic of South Africa.

This page describes the standing terms every account accepts, as built. A Landowner's own signed subscription or Enterprise agreement controls over this page for anything it addresses directly; individually negotiated pricing and terms live in that agreement, not here.
